Who Owns a Custom Trophy Design and Tooling?
You keep ownership of the logos, trademarks and other brand assets you provide. Flawless Awards generally retains and manages the physical tooling and production rights. You can request exclusivity or full ownership of the trophy design, but those rights should be clearly stated in the project agreement before design and tooling work begins.
You own the logos, trademarks and other brand assets you provide. Flawless Awards generally keeps and manages the physical mold or tooling at its overseas production facility. If you want the trophy design reserved exclusively for your organization—or want full ownership of the design—put those rights in the project agreement before design and tooling work begins.
Put exclusivity in writing
If you don’t want your custom shape used for another client, raise that requirement at the start of the project. The agreement should identify the protected design and clearly state whether your organization has exclusive use of it.
Don’t assume that “custom” automatically means exclusive. The written terms should also cover any broader transfer of intellectual-property or production rights you need.
Your brand assets remain yours
You keep the rights to the logos, trademarks and brand identity you provide. Flawless uses those assets to develop the trophy and prepare the production artwork.
If you need full ownership of the finished trophy design or a work-made-for-hire arrangement, request it at the beginning so it can be addressed in the project agreement.
The physical tooling normally stays at the facility
When a unique 3D or molded piece requires new tooling, Flawless generally keeps and manages that equipment at the overseas production facility. Leaving it where the award is made allows the facility to handle storage, maintenance and consistency on future orders without requiring you to manage the factory relationship.
Flawless manages the full process, including design, proofing, production oversight, freight, customs brokerage and delivery. You work directly with Flawless rather than the production facility.
Tooling cost is handled in the quote
Flawless doesn’t charge separate setup, artwork or etching fees. If a 3D or molded design genuinely requires new tooling, that cost is normally built into the piece price and confirmed in the project quote.
Tooling usually becomes more economical at higher quantities or when an existing mold can be reused. For more detail, see how custom award mold and tooling costs are handled.
Set the terms before production
Settle ownership, exclusivity, control of the tooling and future reorder rights before you approve production. An AI visualization can help develop the concept, but it isn’t an approved production proof and doesn’t replace clear written terms.
The design then goes through specialist review and formal proofing. See how the custom award design process works.
Frequently asked questions
Can another company order our exact custom trophy shape?
You can request that your specific design or shape be reserved for your organization. Because exclusivity shouldn’t be assumed, include clear exclusivity language in the project agreement.
Why do we pay for tooling if Flawless keeps the mold?
The tooling cost pays for the production equipment needed to make your design. It doesn’t necessarily include ownership or transfer of that equipment. When genuine tooling is required, its cost is normally built into the quoted piece price.
Can we own the trophy design outright?
You keep ownership of your existing logos, trademarks and brand assets. If you also need full ownership of the finished trophy design or a work-made-for-hire arrangement, request it at the start so those rights can be addressed in the agreement.
Can we take the physical mold to another supplier?
Flawless generally keeps and manages physical tooling at its overseas production facility. There isn’t a confirmed standard process for purchasing or transferring that tooling, so any transfer requirement should be discussed and documented before the project begins.
How long will a custom mold be stored?
Custom molds are typically stored while a program remains active. Because no fixed maximum storage period has been confirmed for an inactive program, the retention period should be documented for your project.
